This Cancellation and Refund Policy (“Policy”) governs the terms under which cancellations of event registrations and artist service bookings made through the “The Art Vents” platform/website (“Platform”) are processed, and the conditions for issuing refunds by Homies Roam LLP (“Company,” “we,” “us,” or “our”). This Policy is to be read in conjunction with our Terms and Conditions and Privacy Policy.
By registering for events or booking artist services through the platform, you acknowledge that you have read, understood and irrevocably agree to be bound by this Policy. If you do not agree with any part of this Policy, you must immediately cease all use of our platform and services.
ARTICLE 1: SCOPE AND APPLICABILITY
This Policy applies to all event registrations, workshop bookings, and scheduled services provided by Artists facilitated through the Homies Roam LLP platform.
ARTICLE 2: GENERAL PRINCIPLES
2.1. Policy Acceptance: Your payment for any event or service on the Platform signifies your acceptance of this Cancellation and Refund Policy. 2.2. Company’s Right to Modify/Cancel: The Company reserves the right to cancel or modify any event or service at any time, for any reason. In such instances, the refund provisions outlined herein shall apply. 2.3. Non-Transferability: Unless expressly stated otherwise, event registrations and service bookings are non-transferable. 2.4. Applicable Law: This Policy is governed by the laws of India, specifically as applicable in the State of Maharashtra.
ARTICLE 3: CANCELLATIONS BY THE USER
3.1. Event and Workshop Cancellations (Pre-Booked Slots): For cancellations of pre-booked event or workshop slots by the User, the following refund structure applies:
3.1.1. More than 72 hours prior to the scheduled start time: A refund of 80% of the total registration fee will be issued. The remaining 20% will be retained as an administrative and processing fee.
3.1.2. Between 24 hours and 72 hours prior to the scheduled start time: A refund of 50% of the total registration fee will be issued. The remaining 50% will be retained as a cancellation fee.
3.1.3. Less than 24 hours prior to the scheduled start time, or No-Shows: No refund will be issued. The user will be responsible for the full scheduled fee.
3.2. Independent Artist or Music, Art or Dance Academy Service Bookings (Pre-Booked Appointments): For cancellations of individual artist or music, art or dance academy service bookings pertaining to music coaching, private classes and/or consultation slots by the user, the following refund structure applies:
3.2.1. No-Shows: No refund will be issued. The User will be responsible for the full scheduled fee.
3.3. How to Request a Cancellation: All cancellation requests must be made by the user through the Platform’s designated cancellation feature or by contacting our customer support team at contact@theartvents.in. The time of the cancellation request will be determined by the timestamp of the request received by our system.
ARTICLE 4: CANCELLATIONS BY THE COMPANY OR ARTIST
4.1. Cancellation by the Company: If Homies Roam LLP cancels an event or a service booking due to unforeseen circumstances (e.g., force majeure, artist unavailability, technical issues), Users who have registered or booked will be offered: 4.1.1. Full Refund: A 100% refund of the paid fee. 4.1.2. Rescheduling Option: An option to transfer their registration/booking to a rescheduled date or a similar alternative event/service, if available. Users will be notified of such cancellations and the available options via email or platform notifications or other primary communication channels.
4.2. Cancellation by the Artist: If an Artist cancels a pre-booked service or participation in an event facilitated by the Platform: 4.2.1. The Company will endeavor to provide a suitable alternative Artist or service, subject to availability. 4.2.2. If no suitable alternative can be provided, a full refund of the paid fee for that specific service or event will be issued to the User. The Company will facilitate communication between the user and artist regarding such cancellations and the available options.
ARTICLE 5: REFUND PROCESSING
5.1. Refund Method: All eligible refunds will be processed back to the original payment method used for the transaction. The Company is unable to process refunds to alternative payment methods. 5.2. Refund Timeline: Refunds will typically be processed within 7 to 10 business days from the date of approval of the refund request. The actual time for the refunded amount to reflect in your account may vary based on your bank or payment processor’s policies. 5.3. Currency: All refunds will be processed in Indian Rupees (INR). The Company is not responsible for any foreign exchange fluctuations that may occur between the time of payment and refund for international transactions. 5.4. Non-Refundable Items: Any non-refundable charges, such as convenience fees, processing fees, or third-party service charges, will not be included in the refund amount unless explicitly stated otherwise.
ARTICLE 6: EXCEPTIONS AND SPECIAL CIRCUMSTANCES
6.1. Medical Emergencies/Extenuating Circumstances: While the standard cancellation policy applies, the Company may consider exceptions for cancellations due to verifiable medical emergencies or other severe extenuating circumstances on a case-by-case basis. Such requests must be accompanied by appropriate supporting documentation and submitted within 24 hours of the scheduled event/service. Approval for exceptions remains at the sole discretion of the Company. 6.2. Disputes: Any disputes regarding refunds should be directed to our Grievance Officer as per our Privacy Policy, kindly refer to the same.
ARTICLE 7: AMENDMENTS TO THIS POLICY
Homies Roam LLP reserves the right to modify or update this Cancellation and Refund Policy at any time without prior notice. Any changes will be effective immediately upon posting the revised Policy on the Platform. Your continued use of the Platform and its services after any such modifications constitutes your acceptance of the revised Policy. We encourage you to review this Policy periodically to stay informed.
